Illegal immigrant protestors arrested at Arpaio racial profiling trial

There was more drama outside the Susan Day O’Connor federal courthouse in Phoenix than inside the courtroom Tuesday — where Sheriff Joe Arpaio said his office did not make arrests based on people’s “color of their skin” — as about 50 people demonstrated in the street, including several illegal immigrants who had come willing to be arrested.

Four immigrants with no legal status were handcuffed and taken away by city police after they blocked a nearby intersection, with an unfurled a banner that read “No Papers, No Fear,” for about an hour. Each one sat on one corner of the banner and chanted “Dignity is fighting here. No papers, no fear.” with the crowd.

They all knew they were going to be taken into custody and issued a statement beforehand.

Leticia Ramirez, a mother of three who has lived undocumented in the U.S. for 18 years, said goodbye to her daughter as the tearful toddler before she was handcuffed and taken away. “We’ll see each other Wednesday,” the woman told the girl. “Give a kiss to your little brother and your Papi, okay?”

“He’s been casing our community, he’s been chasing my people and I’m here to tell him that I’m making his job easy,” Ramirez said. “I’m not going to stand for what he’s doing to my community. and come get me.r. stop chasing my comty. im here come get me.

Another protestor defiantly told someone videotaping the protest for Puente AZ, the grassroots organization that organized the protest, that she would gladly be arrested for the cause.

“And I’m going to sit here,” said the woman, who identified herself as Natally, 24, and said she had been in the U.S. illegally for 16 years.

“Every day I run that risk, every day. Either driving or doing anything. It’s the same thing as sitting here and saying ‘I am undocumented and unfraid.’”

Miguel Guerra, another one of the protestors arrested, said the act was meant to show a strong message to Arpaio and his deputies: That they were no longer afraid.

“I am not afraid to be here and tell Arpaio that we are not afraid,” Guerra said. “We are here to tell him that we are not criminals. We are coming out to say we are not afraid and that the real criminal is inside, testifying. Not us.”

The demonstration appears to be orchestrated by the grassroots community-based group called Puente, that sent out a statement for the four and is collecting funds for their bail.

“They showed great leadership today,” said a man speaking for the organization. “They made their own decisions. It was a difficult decision.

“But the community is going to be there for them because they are there for the community. They are representing us.”

Phoenix police say the four were arrested for blocking an intersection and will likely face a misdemeanor charge of failure to obey law enforcement orders.

The four live in Phoenix and range in age from 24 to 37, according to Puente and a website called Standing On the Side of Love that fights oppression.

“If you’re reading this, it’s because I and three others are in jail,” Ramirez wrote. “Today four of us who are undocumented members of Puente came out as unafraid and were arrested at the racial profiling trial of Sheriff Arpaio here in Phoenix. We did peaceful civil disobedience to set an example for our community and to show Arpaio we aren’t hiding any more.

“We know no human being is illegal. What Arpaio is doing to our community is illegal,” Ramirez wrote. “Before, our biggest fear was ending up in his jail. Today, we went in with our heads high because its better to be out of the shadows than in them.

“We went in feeling safe because we know we have a community that supports us. We’re willing to risk everything because we know that you have our back.”

She said the protest was the first of many planned actions this summer as part of the  “No Papers No Fear Ride for Justice” that takes off from Phoenix this Sunday. The caravan will intends to travel the country for six weeks visiting with immigrant communities.

“Challenging our fears and challenging the Sheriffs that cause them,” Ramirez said.

“It’s a new day in Arizona and everywhere. We’re losing our fear and uniting to peacefully defend ourselves.”

    We’re always told how “hard working” they are.. yet 75% of Hispanics are on some sort of means tested welfare and looking at every picture I see of them, they’re fatter than hell.

    Apparently these lawbreakers think that they OWN the COMMUNITY comprised of their fellow illegal squatters. Here. In OUR country, the United States. She-pig appears to be under the impression that she can not be held accountable for ANYTHING due to her inclusion in her special community. Free ride. No American lawman can touch them for ANYTHING. She and her illegal friends rebuff the police as interlopers in HER community within OUR country. Filthy law breaking pig! Squatting hag!

    I’m not a republican, but I will be voting for one this election, and pray to God he will get our immigration laws enforced. I’m sick of obama pandering to these people who have NO RIGHT to be in this country. The illegal aliens who don’t have our jobs, are using this country as a welfare country with their anchor babies, (illegal alien children). Why should illegal aliens be entitled to a DREAM Act? They are in this country ILLEGALLY no matter how they got here. It’s time to get these illegal aliens back to their own country where they belong. They DO NOT belong here!
    Illegal immigration is a cancer, it has to be eradicated not tolerated.
    Where is ICE to round up these illegal aliens? WHERE? Why weren’t they at least arrested and held for deportation?

    I’m sure tired of seeing and hearing about illegal imigrants playing like victims. I don’t feel a bit sorry for people who come over the border illegally when they have other options and can make it legal. I’m tired of paying hospital bills, feeding and educating them when we have American citizens who need the same help and are not able to get it. Have these illegals no shame?

    Those who are aliens in the USA illegally have their rights waiting for them back in their homeland. If they want to protest for their rights then they will have to protest their own government. I have no obligation to grant them rights afforded US citizens and legal immigrants. I will oppose any attempts to colonize the USA, in city council, the courts, or violently, as needed.

      Just because the term “undocumented persons” does not appear in the U.S.
      Constitution does not mean that its rights and freedoms do not apply to
      them. The courts have held otherwise.

      While many argue that “We
      the People of the United States,” refers only to legal citizens, the
      Supreme Court has consistently disagreed.

      Read:

      In Yick Wo v. Hopkins, a case involving the rights of Chinese
      immigrants, the Court ruled that the 14th Amendment’s statement, “Nor
      shall any State deprive any person of life, liberty, or property without
      due process of law; nor deny to any person within its jurisdiction the
      equal protection of the laws,” applied to all persons “without regard to
      any differences of race, of color, or of nationality,” and to “an
      alien, who has entered the country, and has become subject in all
      respects to its jurisdiction, and a part of its population, although
      alleged to be illegally here.” (Kaoru Yamataya v. Fisher, 189 U.S. 86
      (1903) )

      Wong Wing v. U.S. (1896)

      Citing Yick Wo v.
      Hopkins, the Court, in the case of Wong Wing v. US, further applied the
      citizenship-blind nature of the Constitution to the 5th and 6th
      amendments, stating “. . . it must be concluded that all persons within
      the territory of the United States are entitled to the protection
      guaranteed by those amendments, and that even aliens shall not be held
      to answer for a capital or other infamous crime, unless on a presentment
      or indictment of a grand jury, nor be deprived of life, liberty, or
      property without due process of law.”

      Plyler v. Doe (1982)

      In Plyler v. Doe, the Supreme Court struck down a Texas law prohibiting
      enrollment of undocumented persons in public school. In its decision,
      the Court held, “The undocumented persons who are plaintiffs in these
      cases challenging the statute may claim the benefit of the Equal
      Protection Clause, which provides that no State shall ‘deny to any
      person within its jurisdiction the equal protection of the laws.’
      Whatever his status under the immigration laws, an alien is a ‘person’
      in any ordinary sense of that term… The undocumented status of these
      children vel non does not establish a sufficient rational basis for
      denying them benefits that the State affords other residents.”

      Equal Protection

      When the Supreme Court decides cases dealing with First Amendment
      rights, it typically draws guidance from the 14th Amendment’s principal
      of “equal protection under the law.” In essence, the “equal protection”
      clause extends First Amendment protection to anyone and everyone covered
      by the 5th and 14th Amendments. Through its consistent rulings that the
      5th and 14th Amendments apply equally to undocumented persons, they
      also enjoy First Amendment rights.

      In rejecting the argument
      that the “equal” protections of the 14th Amendment are limited to U.S.
      citizens, the Supreme Court has referred to language used by the
      Congressional Committee that drafted the amendment:

      “The last
      two clauses of the first section of the amendment disable a State from
      depriving not merely a citizen of the United States, but any person,
      whoever he may be, of life, liberty, or property without due process of
      law, or from denying to him the equal protection of the laws of the
      State. This abolishes all class legislation in the States and does away
      with the injustice of subjecting one caste of persons to a code not
      applicable to another. . . . It [the 14th Amendment] will, if adopted by
      the States, forever disable every one of them from passing laws
      trenching upon those fundamental rights and privileges which pertain to
      citizens of the United States, and to all persons who may happen to be
      within their jurisdiction.”

      Undocumented persons do not have
      the right to vote or possess firearms but these rights can also be
      denied to U.S. citizens convicted of felonies. The courts have ruled
      that, while they are within the borders of the United States,
      undocumented persons are granted the same fundamental, undeniable
      constitutional rights granted to all Americans.

    Arrested for blocking the intersection will probably not end up in deportation but you can bet the open border crowd will say it is. What is the dignity in forcing your little girl watching you get arrested? The ones that should be cuffed are those promoting this movement.
